This End User License Agreement ("Agreement") is a legal agreement between you ("User") and BitQuail Sp. z o. o. (Limited) ("Company"), a company registered in Poland, governing the use of the Algify software ("Software"). By installing, using, or accessing the Algify software on your local PC, you agree to the terms of this Agreement. If you do not agree with these terms, do not use the Software.

1. Grant of License

Subject to the terms of this Agreement, Company grants User a non-exclusive, non-transferable license to install and use the Algify software. This license is granted solely for use with compatible devices owned or controlled by the User.

2. Restrictions

a. User shall not, and shall not permit any third party to: (i) reverse engineer, decompile, disassemble, attempt to derive the source code of, or decrypt the Software; (ii) modify, translate, or create derivative works based on the Software; (iii) remove, alter, or obscure any proprietary notices or labels on the Software; (iv) use the Software for any purpose that is illegal or prohibited by applicable law.

3. Ownership

Company retains all rights, title, and interest in and to the Software, including all intellectual property rights. User acknowledges that this Agreement does not grant User any rights, title, or interest in or to the Software, except for the limited license rights expressly provided herein.

4. Support and Updates

a. Company may, at its sole discretion, provide User with support services related to the Software. The updates for Algify (including, but not limited to: bug fixes, upgrades, hot fixes, enhancements, modifications, new releases) are provided in the sole discretion of BitQuail Sp. z o. o. (Limited). If Company does provide you with any updates, such updates shall be subject to the terms and conditions of this Agreement (including the License) or such agreement, if any, which accompanies such updates.

5. Disclaimer of Warranty

a. Algify is provided "as is" and "as available," without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. User's use of Algify is at User's sole risk.

6. Limitation of Liability

a. To the maximum extent permitted by applicable law, in no event shall Company or its affiliates be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use Algify. User acknowledges that any trading activities undertaken using Algify are at User's own risk, and Company shall not be responsible for any financial losses incurred as a result of such activities.

7. Termination

a. This Agreement is effective until terminated by User or Company. User may terminate this Agreement at any time by uninstalling or discontinuing use of Algify. Company may terminate this Agreement if User fails to comply with any term or condition of this Agreement.

8. Uninstalling Algify

a. To uninstall Algify from your system, select Programs from the Start button, Algify, and choose "Uninstall Algify". You can also uninstall Algify from the Control Panel under "Add or Remove Programs".

10. Governing Law and Jurisdiction

a. This Agreement shall be governed by and construed in accordance with the laws of Poland. Any legal action or proceeding arising under or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of Poland.

11. No Responsibility for Trading Losses

a. User acknowledges that any trading activities undertaken using Algify involve financial risk and that Company shall not be responsible for any losses incurred as a result of such activities.

12. Complete Agreement

a. By using Algify, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions. You further agree that this Agreement is the complete and exclusive statement of the agreement between you and BitQuail Sp. z o. o. (Limited) regarding the subject matter hereof and supersedes any proposal or prior agreement, oral or written, and any other communications between you and BitQuail Sp. z o. o. (Limited) relating to the subject matter of this Agreement.
